Terms of Service — Inkwell

These Terms of Service and End User License Agreement ("Terms") govern your use of Inkwell (the "App"), published by Bayou Byte Studio LLC ("we," "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility (18+)

Inkwell is intended for adults. You must be at least 18 years old to use the App. By using it, you confirm that you are 18 or older.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use, subject to these Terms and the rules of the app store you obtained it from.

3. Acceptable use

Inkwell is for book discovery and reading. You agree not to misuse the App, including not to: break the law; infringe anyone's rights; attempt to disrupt, reverse-engineer, or gain unauthorized access to the App or its systems; or use the App to harass, threaten, or harm others.

4. Community content and zero tolerance for objectionable content

Community features — such as reviews, posts, and discussions — are being introduced. Where these features are available, the following rules apply, and you agree to them:

  • You are solely responsible for the content you submit.
  • There is zero tolerance for objectionable content or abusive behavior. You may not post content that is unlawful, sexually explicit, pornographic, hateful, harassing, violent, threatening, defamatory, or infringing, or that exploits or endangers anyone.
  • Inkwell is limited to book-related topics; off-topic content may be removed.
  • We may screen, moderate, remove, or refuse any content, and may suspend or terminate accounts, at our discretion.
  • You can report content or users and block users from within the App. We aim to review reports and act on objectionable content within 24 hours, which may include removing content and ejecting the user who posted it.

You retain ownership of content you create. By submitting content, you grant us a worldwide, royalty-free license to host, store, display, and distribute it within the App for the purpose of operating the service.

5. Book information and third-party content

Book details may come from public sources (such as Google Books and Open Library). Where the App displays links or embedded posts from third-party platforms, that content belongs to its owners and is subject to their terms; we do not host or claim ownership of it. Book titles, covers, and trademarks belong to their respective owners.

6. Buying books and affiliate links

Inkwell has no in-app purchases. "Find this book" and similar links open an external online bookstore in your browser. We may earn a commission from qualifying purchases made through those links, at no additional cost to you. We are not responsible for third-party websites, their content, or their transactions.

7. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or fit for a particular purpose.

8. Limitation of liability

To the fullest extent permitted by law, Bayou Byte Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the App.

9. Indemnity

You agree to indemnify and hold harmless Bayou Byte Studio LLC from claims arising out of your content or your misuse of the App.

10. Termination

We may suspend or terminate your access to the App or its features at any time, including for violation of these Terms. You may stop using the App at any time by uninstalling it.

11. Governing law

These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-laws rules.

12. Changes

We may update these Terms. The current version will always be posted at this address with a new effective date. Continued use of the App after changes means you accept the updated Terms.
